AVOID CLIENT/BUILDER DISPUTES
THIS SECTION IS AIMED AT EXTENSIONS AND ALTERATIONS TO DOMESTIC
PROPERTIES -- THE MAIN SOURCE OF CONTRACT DISPUTES
Having carried out Expert Witness work in Court and from experience gained
I feel that Disputes could easily be avoided with the correct approach.
The information given here is free and I hope is of some benefit.
Causes of disputes:-
Clients may not be clear in what they want.
The drawings may not include all of the clients requirements.
Various builders may interpret the information differently.
The quotation may be vague and misleads the client.
Too much emphasis on verbal agreements.
My suggested method applicable to Clients, Designers and Builders
The next spreadsheet 'Prelims' (abbreviation for 'Preliminaries') covers topics to be discussed
between the parties BEFORE any estimate/quotation completed.
Some clients, for example, have no problem with the builder using the toilet but others
may be horrified and an argument takes place on Day 1
The husband gets a phone call at the office from his wife and 'conflict' commences.
The next spreadsheet 'Trades' includes the main headings of work items to be
considered. This is not exhaustive but I feel it is adequate for the needs.
The boxes under each heading could be ticked (included in estimate) or marked
to show if not applicable OR maybe by client direct.
Can also be used to identify which item is being carried out by which specialist.
I would welcome any comments, suggestions regarding this.
